Prosecutors rest their case in Bill Cosby’s sexual-assault trial

Cosby said he chose to pursue a friendship with Constand, which he hoped would grow to something more intimate.

Bill Cosby’s spokesman is dangling the possibility that he may testify at his sexual assault trial, but legal experts say that would be an enormous risk. Although Valliere admitted to writing them, the judge ultimately refused the request for a dismissal.

The comedian, accused of drugging and molesting Andrea Constand in 2004, is said to be in a “good mood” about the way things are going so far, Deadline’s Dominic Patten reported Thursday evening. When asked whether he would “use them for young women you wanted to have sex with”, he answered, “Yes”, but said he never gave the drugs to a woman without her knowledge.

Cosby gave the deposition as part of a lawsuit filed by Constand and later settled for an undisclosed sum.

“She is now telling this jury that this defendant is guilty”, McMonagle argued to Judge Steven T. O’Neill when the jury was out of the room, seeking a mistrial.

Wyatt says Cosby was listening closely as accuser Andrea Constand testified this week, and that he’s confident his lawyers will show they were in a consensual, romantic relationship.

With the state’s case against America’s Dad nearing an end, prosecutors put on the stand a psychologist who testified that victims of celebrities are often afraid to come forward because of the possible backlash.

Cosby replied: “Dead.” The final government witness, toxicologist Timothy Rohrig, said the drowsiness and sedation Constand described in her testimony after accepting three blue pills from Cosby in 2004 could have been caused by a drug similar to Quaaludes – or by Benadryl, the over-the-counter allergy medicine Cosby has maintained he gave to Constand that night. Constand testified this week that the pills Cosby gave her prevented her from articulating that she didn’t consent or physically removing herself from the situation.

Cosby, who was in court today as he has been each day of the trial and most of the pre-trial hearings, has always insisted the encounter with Constand was consensual.

According to the elder Ms Constand, she got it.

Spokesman Andrew Wyatt told reporters on Friday that Cosby’s team was still evaluating whether to have him take the witness stand. Although almost 60 women have levied allegations of sexual assault against him – all of which Cosby and his legal team have vehemently denied – it was the first time he faced a criminal charge.

As he had earlier in the day and yesterday, Montgomery County police officer James Reape read out Cosby’s words in the deposition in response to questions by D.A. Kevin Steele.

Portions of the deposition became public almost two years ago and played a major role in prosecutors’ decision to charge him.

“I don’t think an expert should ever, especially in this case, comment on the credibility of victims”, Valliere testified when asked if such an approach was appropriate.

The comic told cops he gave Andrea one and a half tablets of Benadryl to help her “relax”.

“My wife would not know it was because Andrea and I had had sex and that Andrea was now very, very upset”, Cosby said, according to the transcript.

Cosby, 79, was charged in 2015 with felony aggravated indecent assault shortly before the statute of limitations on Constand’s claim expired.

Prosecutors rested their case against Bill Cosby on Friday – and his team floated the idea that the comedian himself might be up next.
